| ASPORTATION Definitions: i. The detachment, movement, or carrying away of property, formerly an essential component of the crime of larceny. ii. A carrying away; specifically: the carrying away of someone else's property that is an element of larceny. iii. The carrying away or moving the personal property of another. It does not matter how short the distance or slight the movement as long as the person who carries away or moves the property is knowingly and intentionally exercising control of the property without the consent and to the exclusion of the rights of the owner. v. The felonious removal of goods from the place where they were deposited. vi. (law) The criminal removal or taking away of something. vi. The removal of things from one place to another. vii. Permission to detach, move, carry, etc. could have been sought and obtained, but was not possessed at the time of doing act. 2. State and presence of mind and consciousness is fully had while an item is being moved - no somnambulism occurring therein. 3. Intention or plan to gain from act has been or can be established. 4. Purpose intended - the gain - determined to be a very selfish one. 5. Recovery, or restitution afterwards, not possible in the situation. That is, owner won't be able to benefit from the action. 6. Control or administration of detached, shifted, or carried property rests fully with thief or criminal once position is changed. 7. Who moves illegal or without authorization achieves goal(s). 8.
