MUTE OF MALICE

Definition: (law) Refusal to plead.

1. Purposeful and necessary in the opinion of who refuses to plead.

2. Charge or charges listed, is or are clearly heard and understood.

3. The ability to speak will be possessed by temporarily mute person.

5. Record in court will be made to reflect position taken by 'accused'.

6. Proceeding continues and is concluded, i.e., judgment will be passed.

7. Legal representation won't be denied who makes choice to not plead.

8. Outcome of case can't be regretted as a direct outcome of taciturnity.
