Judgment by default
JUDGMENT BY DEFAULT

Definition: Judgment given against a person because he fails to plead or make an appearance in court.

1. Purposeful and necessary for the administration of justice.

2. Processes, procedures used to summon or notify were correct.

3. No representative made an excuse for a silence or an absence.

4. No way that judgment can be annulled (to emphasize).

5. Judge could not have disqualified himself or herself.

6. Adequate grace period given for plea or an appearance.

7. Reasonable in situation to assume that outcome would have been same if accused pleaded or appeared in court.

8. Serves purpose(s), especially if decision of the court can be implemented or executed immediately and efficiently.
