Nolle prosequi
NOLLE PROSEQUI

Definition: (law) An entry on a court record stating that the plaintiff or prosecutor will not continue with part or all of his suit or prosecution.

* All nine elements should be in.


1. Purposeful and necessary, in the opinion of who makes an entry.

2. Entered by unauthorized person, as recognized by the court.

3. Made timely, when a gain can still be had by who gets off.

4. Consultation was held with officials of the justice system.

5. Costs involved, if any, would be affordable for beneficiary.

6. Justice (and public good) will be served by the action taken.

7. Out-of-court or negotiated settlement, takes place afterwards.

8. The mob won't be able to impose own form of justice thereafter.

9. Who escaped trial or prosecution will not repeat the same mistake.
