| WITNESS (2) Definition: A person who gives evidence in court. ______________________________________________________________________ * All eight elements would be in. 1. Purposeful and necessary. 2. Listed and approved as a prospective witness, before commencement of trial or proceedings. 3. Swears on oath or affirms, to be truthful. 4. Will be ready, willing and able to be cross-examined. 5. Tells the whole truth and nothing but the truth. (And/or must never be caught, if he or she lies under oath!) 6. Will always be present in court, and on time, especially at a next adjourned date, to continue testimony, etc. 7. Will not, strictly speaking, be 'a friend of court'! 8.
