| BLACK BAG JOB Definition: An illegal entry by a law enforcement agent. ______________________________________________________________________ * All nine elements would be in. 1. Purposeful and necessary, at the time, to not comply with the law. 2. Lawbreaker acted on superior orders, or can be excused and pardoned by a superior, where he or she exercised a discretion. 3. Unlawful act will be attempted to be rationalized - not justified - especially if a confrontation takes place wherever was entered. 4. The place or places entered illegally is/are the right place(s). 5. There will be no serious damage or injury in the course of entry, and during operation, especially if some resistance was put up. 6. No additional unlawful act or action will take place or occur in the place or places that had been illegally entered. 7. Agent is not notorious for illegality. That is, he or she will not be the particular person always committing unlawful acts. 8. The purpose(s) of entry - arrest, search, protection, prevention, etc. - will be fully served by the unlawfulness, as exactly hoped. 9.
