TRIAL (1)

Definition: A formal examination of evidence in court by a judge and often a jury, to decide if somebody accused of a crime is guilty or not.

1. Purposeful (see definition).

2. Necessary to bring matter for court's adjudication.

3. Charge is made known to the accused before arraignment.

4. Procedures employed are correct. That is, filing, plea taking, adjournments, applications, etc. are as stipulated by court's rules, regulations, etc.

5. Court is competent and has jurisdiction to hear case/matter.

6. Fair hearing is guaranteed during the proceedings. That is, not a shambolic exercise.

7. Evidence would be complete from the prosecutor's and defence's points of view. That is, there would be representation to adduce evidence and/or to try and make a rebuttal!

8. Judge must be incorruptible. And/or jury must be balanced, in terms of gender, classes, in the right frames of mind, etc.

9. The totality of the examination must be seen, by the 'reasonable man' to have served its purpose, in the course of justice; complete and true.

10. There should be a room for an 'appeal', even if a retrial will be ordered, whether initial judgment finds the accused guilty (= convicted) or innocent (= discharged).

11. Period that case lasts will not be considered unreasonable, especially in the opinion of the accused. And formalities during process will not be chaotic. And evidence and/or proceedings will be preserved

12. Case will not be ruled as a mistrial in the end. That is, matter will be concluded, whatever the 'antics' of judge(s), juror(s), bailiff(s), attorney(s) or solicitor(s), witnesses, accused, etc. In other words, formal examination serves purpose(s).
