Definition: The process of keeping somebody in prison while they are waiting for their trial.

* All seven elements should be in.


1. Purposeful and necessary (see definition).

2. Court has or had jurisdiction, or authority is lawful. And ruling that committed person to prison is legal.

3. Accused - or inmate - is the right person. (To emphasize.)

4. No crime is committed and no injury is sustained while being held.

5. Period of detention is appropriate in the opinion of the accused.

6. Kept in section of prison for 'awaiting trial inmates', not mixed with hardened criminals, convicted rapists or death row inmates. (To emphasize.)

7. Trial still holds in the end. That is, person does not escape from place before the trial. In other words, prison serves purpose, as exactly hoped for.
