| PROCEEDING (1) Definition: (formal) [ ~ (against somebody) (for something) ] The process of using a court to settle a disagreement or to deal with a complaint. ______________________________________________________________________ * All ten elements should be in. 1. Purposeful and necessary. 2. Proper lodgement of complaint by the party/parties involved. And acceptance by the court. __________________ 3. Hearing notice is served on the party/parties against whom the complaint is/was lodged or to justify the other side to disagreement. 4. Notice of hearing is received and acknowledged (connect to #3). __________________ 5. Representation and/or presentation of case is made by the representative(s), where applicable, or complainant(s). 6. Response or reply is provided by the 'defendant' (connect to #5). __________________ 7. Scrutiny, assessment and cross-examination, where necessary, is conducted. 8. (Reserved.) (Friend of court's commentary is heard, or an order for an out of court settlement, is made by court.) __________________ 9. Ruling or pronouncement is made by court (= judge or jury). 10.
