Plea-bargaining (1)
PLEA-BARGAINING (1)

Definition: (law) An arrangement in court by which a person admits to being guilty of a smaller crime in the hope of receiving less severe punishment for a more serious crime.

1. Purposeful and necessary for the arrangers !

2. The smaller crime admitted was actually committed - not used as a route to receiving a less severe punishment.

3. Decision to accept the arrangement is of the freewill of the accused - after legal advice is obtained from lawyer or prosecutor, etc., as appropriate.

4. Less severity of punishment is only in the opinion of offender. That is, it does not wipe out, in law, the fact of a conviction.

5. Punishment is served or fine paid in full. That is, bargain is never a suspended sentence! (To emphasize.)

6. Arrangement is legal in the jurisdiction where it is made. That is, there will be no retrial as a result of 'bargain' being ruled illegal, whatever the nature of the serious crime.

7. Arrangement is offered only once. That is, an accused who previously benefited from a plea-bargain does not get a second opportunity.

8. On serving less severe punishment, crime - small or big - is not repeated again or committed anew. (Connect to #7.)
