NEGLIGENCE (1)

Definition: (formal or law) The failure to give somebody/something enough care or attention.

1. Purposeful, even if unintended and/or unnecessary.

2. Person/thing is deserving of or entitled to more care or attention that is being currently received.

3. Adequate care or attention is possessed by the party that fails to give more or appropriately.

4. No plausible or possible reason or justification exists for not giving adequate care or attention.

5. Person or thing makes a request or the legal right that exists, granting person/thing a privilege, is clearly heard/known. That is, there is an awareness, by the party that refuses to do more, for the need to give more care or attention.

6. A loss accrues to the person/thing that gets less care or attention, from the insufficiency.

7. Party failing to give enough care or attention is not expected to be 'unbecoming' or carefree (connect to #3 & #4, to emphasize).

8. A penalty exists and is, or can be, suffered, by the 'careless' party, for the neglect shown.
