| MISDIRECTION (3) Definition: (law) (of a judge) The action of giving the jury (= the group of people who decide if somebody is guilty of a crime) wrong information about the law. ______________________________________________________________________ * All eight elements would be in. 1. Judge has a purpose and considers it necessary to misinform. That is, does wrong deliberately (connect to #2 & #3). 2. 'Milord' knows the law. But won't admit the mischief committed under any condition. 3. Judge has compromised position. That is, has entered into an unethical 'covenant' with the devil. Or has sold his or her conscience to one of the parties (or to the highest bidder!). 4. No member of the jury knows what the right thing on or about the law is, or asks a question to seek a clarification. Or judge gives further wrong information, where a question is asked. 5. There is no possibility of a friend of the court, a judge advocate, etc. intervening, or interfering, or contributing, in such a way as to give a correct information (= meaning or interpretation). 6. Action that acts as a guide for the jury, results in an injustice or a miscarriage of justice. That is, information provided by judge is made use of in arriving at a (wrong) decision. 7. Act achieves objective(s). That is, judgement is not dismissed at a higher court, on appeal, or proceedings declared a mistrial. 8. (Reserved.)
