| LITIGATION Definition: The process of making or defending a claim in court. ______________________________________________________________________ * All nine elements should be in. 1. Purposeful and necessary for the litigant(s), and especially for their solicitor(s)/lawyer(s)! 2. Commences promptly, not at an inauspicious period or when considered time-barred. 3. Procedures adopted in filing, service, etc. are correct and proper. 4. Court has jurisdiction or competence, and does not throw out matter for a technical reason, or refer matter outside the judicial system for settlement or arbitration. That is, the judge or judges will not shirk his/her/their responsibilities. 5. Defended stoutly, diligently and robustly - even if it will be discontinued at a point in time before judgment. 6. Costs will not be exorbitant. That is, financial implication will not be overwhelming for litigant(s); NOT COSTLY. 7. Will not take 'forever' to be concluded; NOT LONG (connect to #6). 8. Achieves objective(s) or serves purpose(s). And no resort will be made to an extra-judicial measure to achieve goal(s) - in pursuit or defence of justice. 9. (Reserved.)
