| LAWSUIT Definition: A claim or complaint against somebody that a person or an organization can make in court. ______________________________________________________________________ * All eight elements should be in. 1. Purposeful and considered a necessity (connect to #6 & #7). 2. Claim or complaint will be specific and identifiable, with clear issues for the determination of the court - not made up or left for the court to find out. 3. Respondent will be timely served with the appropriate legal papers. 4. Can be entertained by court - not time-barred, disallowed by a lack of jurisdiction, and not likely to be rejected/dismissed on the ground of a technicality. 5. The accuser or complainant and respondent or defendant, has a capacity to prosecute or defend claim - to testify, provide evidence, call witnesses, cross-examine, etc. - however long consideration/trial will last. 6. (Reserved.) (Case can be won, even if this will be on an appeal.) 7. Will not be abandoned after it is lodged in court, although it may be eventually settled out of court. 8.
