JUSTICIARY (2)

Definition: Th process by which justice is done.

* All twelve elements should be in.


1. Important and considered vital to do justice.

2. Accusation(s) and charge(s), issue(s) or matter(s) in dispute or contention, etc. is/are made known or disclosed early or timely.

3. Rights are read and privileges, if any, are granted transparently and promptly to whoever is entitled to benefit.

4. Procedures followed in carrying out process, are as stated in extant laws, current rules and valid regulations. That is, a plea, pleading, bail, etc. will not be denied, where an applicant is eligible for such.

5. Opportunities for both, or all sides, to present case will be available. And all parties must be heard fully by judge, jury, etc.

6. Members of the bench, officials or operators of/in the criminal justice system, political leaders, etc. will not be shielded by the law in the course of process. That is, no manipulation takes place.

7. Every step or action will be defensible in law. That is, there will be no need to appeal to a higher authority before claiming or securing a right that should have been instant, or immediate, in furtherance of justice.

8. Accuser(s), claimant(s), etc. will be available to be confronted by who makes allegation(s), counter-claim(s), etc.

9. Ruling or judgement will be delivered timely. And evidence of this provided promptly to the litigant(s) who may demand same.

10. Appeal to a higher or to the highest judicial organ or court (where applicable) will be guaranteed in situation.

11. No threat, blackmail, intimidation, etc. will be applied to secure a discontinuation of an issue or the withdrawal of a case that is already in court.

12. Completion of process will not lead to jungle justice. That is, no taking the laws into own hands, by a dissatisfied party, will occur after the conclusion of a legal trial, etc.
