FORFEITURE (1)

Definition: (law) The act of forfeiting something.

1. Purposeful and necessary.

2. Legal. That is, ruling is made by a judge, with appropriate jurisdiction, in a competent court of law.

3. Process before commencement and conclusion of act is followed in accordance with stated statutes or officially approved rules and regulations.

4. Conditions applicable, if any, for repossession, etc. are clearly stated in the ruling.

5. Thing forfeited is fully owned by the offender. That is, no encumbrance, declared or undeclared, on the item or object to be taken or forcefully seized.

6. No resistance to seizure or forceful collection that may result in an unplanned loss such as an injury, etc., especially to persons effecting an order.

7. There is a regret for thing being forfeited. That is, some loss will arise from the act, for the former owner of thing taken away. In other words, thing has some value.
