| FORCED ENTRY Definition: An occasion when somebody enters a building illegally, using force. ______________________________________________________________________ * All nine elements would be in. 1. Purposeful for the person committing illegality. 2. Person considers it a necessity to enter building without permission or authorization. And knows that action is an offence or illegality (Connect to #3.) 3. Attempt(s) made or that could have been made to obtain permission to enter place is rebuffed or unsuccessful. Or there was no possibility to try to secure legal authorization to enter building. 4. Entrance (= gate, fence, etc.) to building will be damaged, defaced, destroyed, etc. in the process. 5. Building is the right one. And nothing in or on building will be damaged or destroyed on gaining access by forceful entry (connect to #4). 6. Purpose(s) of use of force will be served on gaining entry. 7. Offenders will be apprehended and prosecuted (to emphasize). 8. No unplanned loss arises from act, especially for resident(s), if any, in the building, and no loss of life occurs from illegality. 9.
