There was no miscarriage of justice. That is, trial was competent and convict was truly guilty. 2. Offense is minor, in the eyes of the judge, jury or public. 3. Offender is remorseful or penitent, truly sorry and apologetic. 4. 'Gain', 'benefit', 'profit', 'advantage', etc. secured from crime is retained by the offender, whether or not 'criminal' is fined, jailed, warned or given a suspended sentence. 5. Will not commit an offense again! (Or will not be caught a second time for committing an offense!!) 6.
