| EXCLUSION (2) Definition: A person or thing that is not included in something. ______________________________________________________________________ * All eight elements would be in. 1. Purposeful and necessary for person or thing to be out, even if a benefit will be obtained by including him/her/it. 2. Person or thing anticipated or expected to be fully in, justifiably or unjustifiably. 3. No legal order and no authorization to include person or thing, is flouted or disobeyed. That is, not kept out unlawfully, without approval. 4. Being out will have no negative consequence on the situation, event, etc. that person or thing is being kept away from. 5. A serious loss or significant losses is/are suffered, by the person or thing, as a direct result of being not in (connect to #2). 6. Person or thing cannot force or trick way into where not wanted. 7. Remains out or excluded for appropriate period, as desired by the refusing or rejecting party. 8.
