| EQUITY (4) Definition: (law) (especially British English) A system of natural justice allowing a fair judgement in a situation which is not covered by the existing laws. ______________________________________________________________________ * All nine elements should be in. 1. Purposeful (connect to #2, to emphasize). 2. Considered a necessity to make a judgement in the situation. 3. Person making judgement has an excellent appreciation of human nature and a fair understanding of the meaning of fairness, equity, fairplay and justice. 4. What is allowed is timely effected to help serve purpose(s). 5. System does not help the indolent or a person that is clearly in the wrong. 6. System takes as done what ought to be done. Or system numbs the hardness of the law! (To emphasize.) 7. Operates or is operated without an encumbrance. That is, person (= judge, arbiter, etc.) to dispense 'benefit' or 'sanction' is never under any pressure to decide against his or her conscience. 8. No genuine protest, complaint, etc. will arise in the situation. That is, 'judgement' cannot be successfully appealed. 9.
