Distraint
DISTRAINT

Definition: The action of distraining (seizing somebody's goods to compel him to pay a debt; seizing and selling a person's goods in lieu of receiving payment of a debt).

1. Believed purposeful and necessary by distrainer(s).

2. A warning or appropriate notification precedes act.

3. Nothing will be done with seizure to confer a gain.

4. Recourse to the law won't be possible in situation.

5. No unplanned loss will be suffered by 'the mighty'.

6. There will be a capability or an ability, to return seized items, or sell goods, at the right time to earn the value of the debt.

7. No undue expenditure will be made to safely keep or guard the goods distrained. That is, money will not be spent in the process.

8. Whatever is seized or confiscated will not be damaged in any way, where kept or in the course of forcefully taking possession of same.

9. Action achieves objective(s) - sum owed will be repaid or goods will be sold at a price that gives commensurate value for debt.
