| DEPOSITION (3) Definition: (North American English) (law) A formal statement, taken from somebody and used in court. ______________________________________________________________________ * All nine elements should be in. 1. Purposeful and necessary. 2. Person was cautioned properly, that is, told the full implications of making a formal statement - with or without a lawyer being present! 3. Not made through a third party or with an interpreter. 4. Clear and concise and satisfactory to the person who writes or says things in statement. 5. Signed, dated, with time stated and appropriately endorsed. 6. Witnessed and countersigned, if necessary, by a third party who is present at the time statement is being made. And also by the law enforcement or security agent(s). 7. (Reserved.) (A copy is given to person who makes statement.) 8. Statement is admissible in court (to emphasize). 9.
