| CONSTRUCTIVE DISMISSAL Definitions: i. (British English, law) A situation in which you are forced to leave your job because it is changed in a way that makes it impossible for you to continue doing it. ii. If an employee claims constructive dismissal, they begin a legal action against their employer in which they claim that they were forced to leave their job because of the behaviour of their employer. ______________________________________________________________________ * All seven elements would be in. 1. Never deliberately planned or designed. And never truly expected. 2. Grievances, complaints, grumblings, etc. have all been expressed. 3. Who gets fired has no blame or fault for the changes that occur. _______________________ "THANK YOU ...," (See perfect EMPLOYEE ENGAGEMENT.) 4. Who gets finally fired would have seen sack coming. That is, alleged or claimed 'incompetence' or 'inefficiency', 'uselessness' or or 'worthlessness', would have been pointed out to him or her before decision to leave is made. 5. Suit or case, where applicable, will be given accelerated hearing and judgement passed in good time. Or an out of court settlement will be concluded at the earliest possible time. 6. Losses that will be suffered by laid off staff and employer will be minimal. And there will be no likelihood of a recall or reinstatement in situation. 7. All the entitlements due to 'dismissed' staff will be timely paid. That is, the terms and conditions of service/employment will not be breached as a result of 'emergency departure', unless ... . __________________________ " ... GO IN PEACE".
