COMMUTATION (1)

Definition: (law) The change of (a punishment) into another less severe, reduction of sentence.

1. Purposeful and necessary.

2. Earlier trial was legal and met all the rules of due judicial processes and procedures.

3. Convict was pronounced guilty (even if actually innocent) and sentenced to a term of days, months, years or life (or rarely, a fine).

4. Where applicable, convict took and exhausted all avenues for appeal (and failed in the attempt(s) to upturn the guilty verdict).

5. Reduction has a legal backing. That is, there will be a basis for decision to show kindness. In other words, change will not and cannot be ruled as illegal afterwards or in the future.

6. Achieves goal(s), without a regret or an unplanned loss being suffered by a system or the larger society.
