Citizen's arrest
CITIZEN'S ARREST

Definition: An arrest made by a member of the public, not by the police.

* All eight elements should be in.

* N.B. In the name of ... the law.


1. Purposeful: no disorder in the society.

2. Necessity in the opinion of arresting party. That is, police is not close by or easy to contact timely: no doubt.

3. Right suspect/'criminal': no mistaken identity.

4. Backed with the force of law. That is, action is not likely to be ruled as illegal, in the future, by a competent court: no injustice.

5. No injuries to the person arresting and/or to the person(s) being arrested: no scuffles!

6. Person arrested is handed over to the Police. Or the Police arrives timely to take custody of the suspect (That is, 'criminal' is never handed over to a mob!): no escape.

7. Suspect is appropriately treated by the Police - cautioned/warned, arraigned/charged or ... (summarily ...?) ... .: no regret.

8. Citizen who made arrest is not himself or herself a criminal that is/was wanted by the law!: no guilt.
