| SUING (1) Definition: The act of instituting legal proceedings against a person or institution, typically for redress. ______________________________________________________________________ * All nine elements should be in. 1. Purposeful or necessary for who sues. A move for equity, fairness, justice. * 2. Alternative(s) believed not available. No dispute resolution body. An attempt being made to fight for right. * 3. Matter of interest/concern justiciable. Don't have a forlorn hope. Not ever a joke or suing for suing's sake. * 4. Court of law sued in has a jurisdiction. Be lower or higher court. Hope Me time & resources won't be wasted. * 5. Process not beyond statute of limitation. Filing correct & timely. Costs may be awarded against party suing. * 6. Intention to see case to a conclusion had. Legal fees may mount. Peanuts may be the only award that the court will give. * 7. Process of law left to take natural course. Need not know judge. Clearly ensure court's time is not wasted. * 8. Ready and willing to abide with the outcome. Win or lose or... . Know that appeal may still not be favourable. * 9. Serves purpose(s) and achieves objective(s). Shows unwillingness to be quiet to an injustice. | |
