| CHARGE (3) Definition: An official claim made by the police that somebody has committed a crime. ______________________________________________________________________ * All eight elements should be in. 1. Purposeful - the making of a statement. 2. There is a basis for what is alleged (= statement). _______________________________________ MORE THAN A MERE ACCUSATION. 3. Statement can be tendered authoritatively. That is, what is said is or can be accepted to be further examined legally. 4. Made at the appropriate place - court! That is, officially tabled before a competent, hallowed 'temple' of justice. __________________________________ SUSTAINABLE, NOT DEFECTIVE. 5. Defended. That is, accused will or has a chance of stating own case, whether to deny (= not guilty) or to admit (= guilty) what the police says or said. 6. Charge (= offence), where sustained, has a punishment in the statutes. (To emphasize.) ___________________________________ NOT POLITICALLY MOTIVATED. 7. Charge (= claim, accusation or allegation) is pursued to its logical conclusion. That is, matter brought to court by police is not withdrawn for lack of diligent prosecution or under the power of a 'nolle prosequi'. 8.
